Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Divvy It Up platform, website, and services (collectively, the "Service") operated by Divvy It Up ("we", "us", or "our"). By using the Service, you agree to be bound by these Terms.
1. Account Terms
- You must be at least 16 years old to use the Service.
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account and password.
- You are responsible for all activity that occurs under your account.
- One person or legal entity may not maintain more than one free account.
2. Organizations and Teams
When you create an organization, you become its Owner. You may invite other users to join your organization as Co-Owners, Managers, or Employees. Each role has different permissions as described in our documentation.
Organization Owners are responsible for the data and activity within their organization. Removing a team member revokes their access but preserves audit history.
3. Payment and Billing
- Some features of the Service require a paid subscription.
- All plans start with a 14-day free trial. No credit card is required for the trial.
- Paid plans are billed monthly. Prices are listed on our pricing page.
- You may upgrade, downgrade, or cancel your subscription at any time. Changes take effect at the next billing cycle.
- If payment fails, we may suspend access to paid features until the balance is resolved.
- All fees are non-refundable except as required by law.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or to violate any laws.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Transmit malware, viruses, or other harmful code.
- Abuse, harass, or threaten other users.
- Interfere with the proper functioning of the Service.
- Scrape, crawl, or use automated means to access the Service without our consent.
- Resell, sublicense, or redistribute the Service without authorization.
5. Your Data
You retain ownership of all data you enter into the Service (client records, tasks, leads, organization settings, etc.). We do not claim intellectual property rights over your content.
We store and process your data only to provide and improve the Service, as described in our Privacy Policy.
You may export or request deletion of your data at any time by contacting us.
6. Public Lead Form
If you enable the public lead form, a public-facing page will be accessible at your organization's URL slug. You are responsible for the content displayed on this page (organization name, logo, welcome text, service types). We are not responsible for leads submitted through the form.
7. Service Availability
We strive to keep the Service available 24/7 but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or unforeseen circumstances. We will endeavor to provide advance notice when possible.
8. Limitation of Liability
To the maximum extent permitted by law, Divvy It Up shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Divvy It Up, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
10. Termination
- You may close your account at any time by contacting us.
- We may suspend or terminate your access if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users.
- Upon termination, your right to use the Service ceases immediately. We may delete your data after a reasonable retention period unless legal obligations require otherwise.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in the appropriate courts.
